RE: The tariff classification of video glasses with built-in flat panel video projector from an unspecified country

Dear Mr. Neville:

In your letter dated April 20, 2015, you requested a tariff classification ruling.

The merchandise under consideration is the Avegant Glyph, which is video glasses incorporating a flat panel video projector and audio functions. The Glyph is a video projector that uses digital micromirror devices (DMD) in a configuration that projects light directly onto the retina of the eyes of the wearer. Moreover, this device has to be plugged into a video source to project the video images. The Glyph does not contain any video recording or reproducing apparatus or a tuner.

The applicable subheading for the Glyph will be 8528.69.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatus; …: Projectors: Other: Color: With a flat panel screen: Other: With a video display diagonal not exceeding 34.29 cm. The rate of duty will be Free.
